To the extent permitted by law, Essential Catering & Events, its employees and agents exclude liability for any loss or damage arising from reliance on information contained on this website.
Nothing in this clause excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law (ACL) or any other applicable legislation that cannot be excluded by law.
2. Australian Consumer Law
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantees, rights or remedies available to you under the Australian Consumer Law (ACL) or any other applicable legislation that cannot be excluded, restricted or modified by agreement.
Where goods or services are supplied to you as a consumer within the meaning of the ACL, you are entitled to statutory guarantees that the goods and services:
- Are of acceptable quality;
- Are fit for purpose; and

Match their description.
Where we are permitted to limit our liability under the ACL, our liability is limited (at our option) to:
- The replacement of the goods or the supply of equivalent goods;
- The repair of the goods;
- The payment of the cost of replacing the goods or acquiring equivalent goods;
- The resupply of the services; or

The payment of the cost of having the services supplied again.
3. Orders
3.1 Placement of Orders
Any order placed through this website constitutes an offer by you to purchase a specified product or service at the listed price (including delivery and applicable charges) at the time the order is submitted.
3.2 Acceptance of Orders
We reserve the right to accept or reject any order at our discretion, including where there is:
- Product or service unavailability;
- A pricing error;

An error in your order.
A binding contract is formed only when:

We confirm acceptance of your order; and
-
Payment has been successfully processed.
3.3 Changes to Orders
- Changes requested within 72 hours of delivery may not be accepted.
- More than three (3) amendments to an order may incur administrative fees.

Confirmed changes will result in an updated order confirmation being issued.
3.4 Order Cancellation
All cancellations must be submitted in writing or via our online platform.
Orders under $500:
Minimum 48 hours’ notice prior to delivery.
Orders over $500:
Minimum 72 hours’ notice prior to delivery.
Cancellations outside these timeframes may incur charges reflecting costs already incurred.
3.5 Cancellation by Us
We reserve the right to:

Refuse service; Cancel orders (in whole or part); Remove or edit content;Terminate accounts, at our sole discretion.
If we cancel an order after payment has been processed, we will provide a refund of the amount paid for the cancelled portion of the order.
4. Delivery and Risk
Delivery times provided are estimates only. While we make every reasonable effort to meet scheduled delivery times, we are not liable for delays beyond our reasonable control.
You are responsible for:
- Providing accurate delivery details;
- Ensuring appropriate access and a safe delivery environment;

Ensuring someone is available to receive the order at the agreed time.
If delivery cannot be completed due to:
- Incorrect address details;
- Restricted access;
-
No one being available to accept delivery;
additional delivery charges may apply, and refunds may not be provided.
Risk in the goods passes to you upon delivery to the nominated address. Once delivered, Essential Catering & Events is not responsible for food safety, storage, handling, or consumption conditions.
5. Food Allergies
Essential Catering & Events will make reasonable efforts to avoid ingredients specified by you as allergens.
However:
- Food is prepared in commercial kitchens where cross-contamination may occur;

We cannot guarantee that any product is completely free of allergens.
To the extent permitted by law, we are not liable for allergic reactions where we have complied with your notified requirements and exercised reasonable care.
Guests with severe allergies are strongly advised to provide their own food from a source that can guarantee no cross-contamination.
6. Pricing
- All prices are in Australian Dollars (AUD).
- All prices are inclusive of GST.
- Prices are subject to change without notice.

Delivery and additional charges are displayed at checkout.
We endeavour to ensure pricing and descriptions are accurate; however, errors may occur. If a pricing error is identified, we may cancel the order and provide a refund.
7. Payment
We accept:
- American Express
- Visa
- Mastercard
A 1.7% surcharge applies to credit card transactions.
Payment must be received in full before dispatch or delivery unless otherwise agreed.
8. Invoices and Receipts
Upon order completion:
- An order confirmation number will be displayed;

A tax invoice/receipt will be issued via email.
9. Limitation of Liability
To the extent permitted by law, and subject to the Australian Consumer Law:
- We exclude all liability for indirect, incidental, special or consequential loss, including loss of profits, business interruption or loss of opportunity.

Our total liability arising out of or in connection with any order is limited to the amount paid by you for that order.
Nothing in these Terms limits liability for:
- Death or personal injury caused by negligence;
- Fraud or wilful misconduct;

Any liability that cannot be excluded under law.
10. Force Majeure
Essential Catering & Events is not liable for any failure or delay in performing its obligations where such failure or delay results from events beyond our reasonable control, including but not limited to:
- Natural disasters;
- Extreme weather events;
- Flood, fire, or storm;
- Road closures or transport disruptions;
- Supplier failures;
- Government restrictions;
- Public health emergencies;

Industrial disputes.
Where such events occur, we may:
- Suspend performance;
- Modify delivery arrangements; or
-
Cancel affected orders and provide an appropriate refund.
11. Privacy
We collect and handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.
By placing an order, you consent to the collection and use of your personal information as described in our Privacy Policy.
12. Governing Law
These Terms and Conditions are governed by the laws of the State of Victoria, Australia.
You agree to submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia in relation to any dispute arising out of or in connection with these Terms and Conditions or your use of this website.
